The Terms of Use (“Terms”) govern your access to, and use of the website located at wowtruck.in (“Website”), owned and operated by WOWTRUCK TECHNOLOGIES PRIVATE LIMITED (“Company”, “we”, “us” or “our”).

By accessing or using the Website you agree to be bound by these Terms, along with our Privacy Policy and Disclaimer. If you do not agree with these Terms, please refrain from using the Website.

1. By using this Website, you represent that you are at least 18 years of age and are legally capable of entering into a binding contract under applicable laws. Where you are accessing the Website on behalf of a company, organization or other legal entity, you represent and warrant that you are duly authorized to bind that entity to these Terms.

2. You agree to access and use the Website solely for lawful purposes and in accordance with all applicable laws, rules and regulations. You shall not:

  • attempt to gain unauthorized access to any portion of the Website or any systems connected to it

  • misuse any logistics related information, operational data or service related systems available on the Website. The Company reserves the right to restrict or suspend access where misuse is suspected

The information made available on the Website is provided for general informational purposes only and does not constitute a binding offer or commitment to provide logistics or transportation services. All services offered by the Company are subject to separate contractual agreements, operational feasibility and applicable laws and regulatory requirements. Any references to transit times, delivery schedules or service availability are indicative in nature and subject to change due to operational constraints and external factors.

4. All content on the Website, including but not limited to, text, images, product specifications, graphics, logos, videos, software, trademark, logos, trade name, branding and other materials (“Content”), is the intellectual property of the Company, its group companies or its licensors and is protected under applicable intellectual property laws. You may access and use the Website for personal and non-commercial purposes only. You shall not:

  • Copy, reproduce, republish, upload, post, transmit, or distribute any Content without the prior written consent of the Company
  • Modify, reverse engineer, or create derivate works from any part of the Website or its Content

These terms and conditions (Service-User terms) apply on the usage of our website www.wowtruck.in (the "Website"), Smart phone Wowtruck Application (the Application) as well as to all information, recommendations and/or services provided to you on or through the Website, the Application or through the Customer Care (The CC) through our phone numbers mentioned in the website. The term 'YOU' refers to the user of our services through Website, the Application and the CC.

The terms and conditions mentioned in this contract along with the Privacy Policy constitute the entire contract between the User(s) and Wowtruck with respect to access to and use of the website / application and the Services offered by Wowtruck, superseding any prior written or oral contracts in relation to the same subject matter herein.

ABOUT WOWTRUCK TECHNOLOGIES PRIVATE LIMITED

WOWTRUCK TECHNOLOGIES PRIVATE LIMITED (hereinafter referred to as ‘Company’ or ‘we’ or ‘us’) is a company registered under the Companies Act, 2013.

THE SERVICE

  • WOWTRUCK’s Technology platform is an enabling platform for a consumer to connect with a third party, independent valid permit holder drivers or vehicle owners or vehicle operators known as The Transport Service Provider hereinafter referred as TSP. Once TSP accepts a request, customer is notified with the details of TSP through sms or or email or Mobile application.
  • WOWTRUCK shall do all the reasonable efforts to connect you with a TSP & the services are subject to the availability of TSPs in or around your location at the moment of your request for transportation services.
  • By using this website and/or Mobile Application or user of the service through The CC you hereby acknowledges that WOWTRUCK is not a transport services provider.
  • It is up to the TSP to offer transportation services, which may be requested through the use of the Website, Application or CC. WOWTRUCK only acts an intermediary between you and the TSP.
  • The user has to note that TSP is your service provider and therefore it is subjected to the contract between YOU and the TSP. WOWTRUCK shall never be a party to such contract.

USER(S) ELIGIBILITY

  • User(s) means any individual or business entity/organization that legally operates in India or in other countries, uses and has the right to use the Services provided by WOWTRUCK. Our Services are available only to those individuals or companies who can form legally binding contracts under the applicable law. Therefore, user(s) must not be a minor as per Indian Law; i.e. user(s) must be at least 18 years of age to be eligible to use our Services.
  • WOWTRUCK advises its users that while accessing the web site/ the application, they must follow/abide by the related laws. WOWTRUCK is not responsible for the possible consequences caused by your behavior during use of web site/application. WOWTRUCK at all the times reserves the right to deny service.

USER ACCOUNTS, OFFERS AND PROMOTIONS

  • WOWTRUCK collects general user data including name, email ID, contact details etc. to facilitate services.
  • It is assumed that all information collected from the user is Correct & Accurate. Misuse and misrepresentation of identity or contact details will lead to automated termination of services or the use of the platform without prior notice to such users.
  • User accounts bearing contact number and email IDs are created and owned by WOWTRUCK. Any promotional discounts, offers and reward points in the form of Wowtruck Money accumulated can be revoked without prior notice in the event of suspicious account activity or malafide intent of the user. In the case where the system is unable to establish unique identity of the user against a valid mobile number or e-mail ID, the account shall be indefinitely suspended. WOWTRUCK reserves the full discretion to suspend a user's account n the above event and does not have the liability to share any account information whatsoever.

USAGE CONDITIONS

  • You are advised to provide accurate information to WOWTRUCK. WOWTRUCK can verify the information that you have provided and choose to refuse the service or use of the Application / the Website without providing reasons.
  • By using the Application or Website you agree to: You have understood your contract with WOWTRUCK for Website / Application usage and you have clearly understood the SERVICE with our CLARIFICATIONS.
  • You will not use the Service or Application for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes.
  • You will not use the Service or Application to cause nuisance, disturbance, annoyance or inconvenience.
  • You will not impair the proper operation of the network.
  • You will not try to harm the Service or Application in any way whatsoever.
  • You will not copy, or distribute the Application or other WOWTRUCK Content without written permission from WOWTRUCK.
  • You will provide us with whatever proof of identity we may reasonably request.
  • You will comply with all applicable law from your City, State and the Country while using the Application or the Service.
  • You will not be damaging the body and/or any other interiors of the TSP Vehicles.
  • You will not be misusing or damaging any of the devices (technical/non-technical) in the TSP Vehicles.
  • You will not be asking the TSP to break any Traffic/RTO/City Police and/or government rules for any purpose. The TSP has the right to refuse such a request by the customer. The TSP also has the right to refuse such a pick-up.
  • You will not be putting pressure on the TSP to overload their vehicles with the consignment than the maximum allowed limit of that vehicle.The TSP has the right to refuse such a pick-up.
  • You will not be shipping goods that are classified as dangerous as per ICAO T.I., IATA DGR, IMDG-Code, ADR or other national regulations for transport.
  • You will not be shipping any goods or materials that is prohibited by any Law, Rule or Regulation of India.

In addition to other reasons mentioned under the Termination clause below, WOWTRUCK reserves the right to immediately terminate the Service and the use of the Application should you not comply with any of the above rules.

GENERAL CUSTOMER BEHAVIOUR WHILE USING TRANSPORT SERVICE THROUGH TRANSPORT SERVICE PROVIDER

  • It is expected that a reasonable behavior shall be followed by the Customers / Recipient of the goods while utilizing the Services offered by the TSP.
  • The Company encourages all its customers to take full responsibility of his/her items. In case of lost items inside the Company during the journey, Company will try to locate the items on a "best-effort" basis but is not responsible for the same in case of loss or damage to the same.
  • All the calls made to the Company's CC are recorded by the Company for quality and training purposes.

REPRESENTATION, WARRANTIES, INDEMNIFICATION AND LIMITATION OF LIABILITY

  • The Company’s aggregate liability to the other, regardless of the theory of liability, for any claim, breach or default under this Agreement, will be limited to only 50% of the value of the goods declared in the statement of the goods which matches with the goods transported or Rs, 50,000/- (Fifty Thousand Indian Rupees only) which ever is less. In Order to claim this liability from the Company due to damage of the goods in transit, the User has to report the damage of the goods along with the"Statement of Goods”caused to the Company in less than 24 Hours from the Delivery Completion time. In no event, the Company will  be liable for special, indirect, incidental, punitive or consequential damages, including, without limitation, loss of profits or lost data regardless of whether the User has been advised of the possibility of such damages.
  • If the User has not declared the goods correctly or missed to declare any goods in the "Statement of Goods" in the Service Request, then the Company shall not be liable for any loss or damages occurred to these unknown goods. The Company will not considered liable to these unknown goods that are not mentioned in the"Statement of Goods"and these unknown goods will be ignored if any such loss or damages occur to these goods.
  • Without prejudice to the above, the Company makes no representation or warranty that:
  • The Services will be uninterrupted, timely or error-free.
  • WOWTRUCK shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of Cargo service offered by TSP or due to the failure of TSP to provide Services to the Customer for any reason whatsoever including but not limited to the Customer's non-compliance with the Services' recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Company or any person or any organization involved in the above mentioned systems.
  • WOWTRUCK will not be liable for any damages of any kind arising from the use of the Service offered by the TSP including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
  • WOWTRUCK will take all reasonable measures to ensure that TSP should fulfill his duty properly but there may be exceptions and if any goods misses the ship or train or flight or bus, WOWTRUCK will not be hold liable for any such compensation. The customer is advised to make alternate arrangement in case the assigned vehicle has not reached due to any reason.
  • The Company shall not be liable for any conduct of the drivers of the Vehicles. WOWTRUCK encourages you to notify any complaints that you may have against the driver of any Vehicles that you may have hired using the WOWTRUCK’s platform.
  • All the vehicles registered with WOWTRUCK platform are continuously tracked using GPS for security reasons only. It is expressly made clear to you hereby that the Company does not own any Vehicles nor does it directly or indirectly employ any drivers for the Vehicles. WOWTRUCK disclaims any and all liability in respect of the drivers and the Vehicles alike.
  • WOWTRUCK shall be entitled at any time without giving any reason to terminate the booking of the TSP Vehicle done by the Customer.
  • Any complaint in respect of the Services or the use of the vehicles supplied by the TSP, the Customer has to inform Company of the same in writing within 24hours ofusing the Services of Company.
  • Estimated Pickup Time (EPT) mentioned at the time of booking is only indicative and approximate and may vary.
  • If you fail to accept delivery of Goods at the time they are ready for delivery, or we are unable to deliver at the nominated time due to failure on your part to provide appropriate instructions, or authorizations, then such Goods shall be deemed to have been delivered to you and all risks and rewards in relation to such Goods shall pass to you.
  • You must ensure that at the time of delivery of Goods, adequate arrangements, including access where necessary, are in place for the safe delivery of the Goods being transported by TSP. We cannot be held liable for any damage, cost or expense incurred to such Goods or premises where this arises as a result of a failure on your part to provide adequate access/ address or any other instructions or arrangements for delivery.
  • Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you have provided to us. You can cancel the booking or provide alternate delivery address.

DELIVERY REJECTED CONSIGNMENTS

  • If the receiver refuses to accept delivery we will try to contact you and agree the appropriate next action.  You agree to pay the TSP that any costs incurred in forwarding, disposing of or returning the consignment and other charges (if any) for the agreed appropriate next action.
  • If you fail to accept delivery of Goods at the time they are ready for delivery, or we are unable to deliver at the nominated time due to failure on your part to provide appropriate instructions, or authorizations, then such Goods shall be deemed to have been delivered to you and all risks and rewards in relation to such Goods shall pass to you.

AMENDMENT TO TERMS OF CONTRACT

The Company shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at Company's website at www.wowtruck.in or the Application on the date that Company may indicate that such addition, variation or amendment is to come into effect.

INTELLECTUAL PROPERTY RIGHTS

  • WOWTRUCK is the sole owner or lawful licensee of all the rights to the web site and its content. Web site content means its design, layout, text, images, graphics, sound, video etc. The web site content embodies trade secrets and intellectual property rights protected under worldwide copyright and other laws. All title, ownership and intellectual property rights in the web site and its content shall remain with WOWTRUCK, its affiliates or licensor's of WOWTRUCK content, as the case may be.
  • All rights, not otherwise claimed under this contract or by www.wowtruck.in, are hereby reserved. The information contained in this web site is intended, solely to provide general information for the personal use of the reader, who accepts full responsibility for its use. WOWTRUCK does not represent or endorse the accuracy or reliability of any information, or advertisements (collectively, the "content") contained on, distributed through, or linked, downloaded or accessed from any of the Services contained on this web site, or the quality of any products, information or other materials displayed, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the Service.

  • Any systematic retrieval of WOWTRUCK content to create or compile, directly or indirectly, a collection, compilation, database or directory (whether through robots, spiders, automatic devices or manual processes) without written permission from WOWTRUCK is prohibited.
  • In addition, use of the content for any purpose not expressly permitted in this Contract is prohibited and may invite legal action. As a condition of your access to and use of WOWTRUCK's Services, you agree that you will not use the web site service to infringe the intellectual property rights of others in any way. WOWTRUCK reserves the right to terminate the account of a user(s) upon any infringement of the rights of others in conjunction with use of the WOWTRUCK service, or if WOWTRUCK believes that user(s) conduct is harmful to the interests of WOWTRUCK, its affiliates, or other users, or for any other reason in WOWTRUCK's sole discretion, with or without cause.

CONSENT TO ELECTRONIC COMMUNICATIONS AND TRANSACTIONS

By clicking the ‘I Agree’ button, you consent to conduct transactions and receive communications, notices and information from us electronically, whether sent by e-mail or other electronic means. Electronic communications shall be deemed to have been received by you when we send the electronic communication to the email address / mobile number that as per our records, or when we post the electronic communication on the Application or the Website.

CHOICE OF LAW AND DISPUTE RESOLUTION

These Terms shall be governed by, and construed in accordance with, the laws of India, without reference to principles of conflicts of law. The parties agree that the courts of Chennai shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, the Application or the Website. You expressly consent to the personal jurisdiction of said courts and waive any objection to such personal jurisdiction based on forums non-convenience or any other basis.
